These Terms & Conditions apply to driving tuition and related services provided by ProCarPass. Please read them carefully before booking.

1. Booking of Lessons

1.1 A driving lesson is considered booked once the pupil and instructor have agreed the date and time. This may be agreed by WhatsApp, text message, telephone, online booking system or another agreed method.

1.2 Once the date and time have been agreed, the appointment is reserved for the pupil. A separate reminder or further confirmation is not required for the booking to remain valid.

1.3 Pupils are responsible for keeping a record of their agreed lesson dates and times.

1.4 If a pupil is unsure whether a lesson has been booked, they should contact their instructor promptly.

2. Prices and Payments

2.1 The current price and duration of lessons will be communicated to the pupil before tuition is provided.

2.2 Unless otherwise agreed, payment for an individual lesson is due no later than the start of the lesson.

2.3 Advance payment is not required for an agreed lesson to constitute a confirmed booking unless the pupil is specifically informed that advance payment is required for that booking.

2.4 Block bookings, promotional offers and practical-test-day services may have different prices and payment requirements. These will be communicated before purchase or booking.

2.5 Any money paid in advance will be recorded and accounted for.

3. Block Bookings and Refunds

3.1 Block bookings may be offered at a discounted rate compared with the standard individual lesson rate.

3.2 If a pupil chooses to end a block before using all prepaid lesson time, lessons already taken will be recalculated at the standard individual lesson rate that applied when the block was purchased. Any remaining balance will then be refunded.

3.3 Any lesson cancelled or rescheduled with less than 48 hours' notice will first be dealt with under the cancellation provisions below before any block-booking refund is calculated.

3.4 The applicable standard lesson rate and block-booking price will be communicated before the block is purchased.

4. Cancellation and Rescheduling by the Pupil

4.1 Pupils must provide at least 48 hours' notice if they wish to cancel or reschedule an agreed lesson.

4.2 Where less than 48 hours' notice is provided, a cancellation charge may be made to reflect the reasonable loss directly resulting from the late cancellation.

4.3 Where the instructor is unable, despite reasonable efforts, to fill the cancelled appointment and consequently loses the income from that appointment, the charge may be up to the full agreed lesson price.

4.4 If the appointment is filled by another paying pupil, the cancellation charge will be reduced as appropriate so that the same loss is not recovered twice.

4.5 Exceptional circumstances may be considered at the instructor's reasonable discretion. Exceptional circumstances do not automatically result in the cancellation charge being waived.

5. Failure to Attend and Lateness

5.1 If a pupil fails to attend an agreed lesson without notice, a charge reflecting the reasonable loss caused may be made. This may be up to the full agreed lesson price where the appointment cannot reasonably be filled.

5.2 If a pupil arrives late, the lesson will normally finish at the originally agreed finishing time.

5.3 If an instructor is late, reasonable additional time will normally be provided where practicable so that the pupil receives the agreed tuition time.

6. Practical Driving Tests and Test-Day Vehicle Use

6.1 Use of an instructor's vehicle for a practical driving test is a separate service from an ordinary driving lesson and may be charged at a different rate.

6.2 The applicable test-day price and what is included will be communicated to and agreed with the pupil before the instructor's vehicle is confirmed.

6.3 The test-day fee may reflect the instructor's total time commitment, any pre-test tuition included, use of the dual-control vehicle during the test, travel and waiting time, insurance and vehicle costs, and other lesson appointments that may need to be kept unavailable to accommodate the test.

6.4 Pupils intending to use an instructor's vehicle should consult their instructor before arranging their practical test to ensure that the instructor and vehicle are available.

6.5 The pupil is responsible for booking, changing and cancelling their own category B practical driving test in accordance with current DVSA rules.

6.6 Providing ordinary driving lessons does not guarantee use of the instructor's vehicle for a practical test.

6.7 The instructor may refuse use of the vehicle where, in their professional judgement, the pupil has not demonstrated a sufficiently safe standard of driving or where use would create an unacceptable safety, insurance or legal risk.

6.8 Where reasonably possible, the pupil will be informed sufficiently in advance if the instructor decides that the vehicle cannot be provided for the test.

6.9 Test-day bookings may require advance payment.

6.10 If a pupil cancels an agreed test-day vehicle booking, any cancellation charge will reflect the reasonable loss caused by the cancellation, which may include income reasonably lost from other appointments kept unavailable for the test.

7. Vehicle Breakdown or Unavailability

7.1 Reasonable steps will be taken to ensure the tuition vehicle is roadworthy, properly maintained and available for agreed lessons and tests.

7.2 If the vehicle unexpectedly becomes unavailable because of breakdown, accident, warning light, puncture or another event outside the instructor's reasonable control, reasonable efforts will be made, where practicable, to arrange an alternative or otherwise assist the pupil. An alternative vehicle cannot be guaranteed.

7.3 Where the agreed service cannot be provided because the instructor's vehicle is unavailable, the pupil will not be charged for the part of the service not provided. Any payment already made for an unprovided service will be refunded as appropriate.

7.4 Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited.

8. Damage to the Tuition Vehicle

8.1 Pupils must follow reasonable instructions from the instructor and operate the vehicle with appropriate care.

8.2 Where damage is caused by a pupil's deliberate, reckless or negligent actions, including ignoring a clear and reasonable safety instruction, the pupil may be responsible for reasonable losses directly arising from that damage, to the extent permitted by law.

8.3 Pupils will not be responsible for ordinary wear and tear, pre-existing faults, mechanical failure not reasonably caused by them, or damage that cannot reasonably be attributed to their actions.

8.4 Any amount claimed will be based on the actual reasonable loss or cost and will take account, where applicable, of insurance cover and any amount recovered from an insurer.

9. Driving Licence, Eyesight and Fitness to Drive

9.1 Pupils must hold the appropriate valid driving licence and be legally entitled to drive the tuition vehicle.

9.2 The instructor may check the pupil's driving licence and entitlement to drive.

9.3 Pupils must satisfy the legal eyesight requirements for driving.

9.4 Pupils must not attend a lesson while under the influence of alcohol or illegal drugs, or where medication, illness or another condition makes driving unsafe or unlawful.

9.5 The instructor may refuse or stop a lesson where continuing would create an unacceptable safety or legal risk.

10. Insurance and Road Safety

10.1 Tuition vehicles will have appropriate insurance for driving tuition.

10.2 Pupils must follow road traffic law and reasonable safety instructions given by the instructor.

10.3 The instructor may take control of the vehicle or terminate a lesson where reasonably necessary to protect the pupil, instructor, other road users or property.

11. DVSA or Test-Centre Cancellations

11.1 A practical driving test may be cancelled or disrupted by DVSA, the test centre, severe weather or circumstances outside the instructor's reasonable control.

11.2 The pupil is responsible for managing their DVSA category B practical test booking and complying with DVSA booking, cancellation and change rules.

11.3 Where DVSA cancels a test, any entitlement to a DVSA refund, rearranged test or expenses is determined by DVSA's applicable rules.

11.4 ProCarPass will provide reasonable evidence or receipts where appropriate to support a legitimate DVSA expenses claim.

11.5 Any ProCarPass charge for services actually provided, or refund relating to services not provided, will be handled reasonably according to the circumstances and applicable law.

12. In-Car Cameras and Recordings

12.1 Dashcams and/or in-car cameras may be used for legitimate purposes including safety, security, incident investigation, insurance matters, training quality and protection of pupils and instructors.

12.2 Pupils will be informed where equipment records identifiable individuals.

12.3 Recordings will be handled securely, access will be restricted and recordings will not be retained longer than reasonably necessary unless they need to be preserved for an incident, insurance claim, legal matter or another lawful purpose.

12.4 Recordings may be disclosed where reasonably necessary and lawful, including to insurers, legal advisers, police, courts or competent authorities.

12.5 Safety and security recording is separate from optional marketing consent. Agreeing to these Terms & Conditions does not by itself give ProCarPass permission to use identifiable photographs or videos of a pupil for advertising or social-media marketing.

12.6 Footage from a practical driving test will not be distributed, circulated or published without any permissions required from the pupil and DVSA.

13. Photographs, Videos and Marketing

13.1 ProCarPass may separately ask pupils for permission to use photographs or videos featuring them for promotional purposes, including on the ProCarPass website, social media or digital advertising.

13.2 Marketing consent is optional. Refusing marketing consent will not affect the pupil's driving lessons.

13.3 Where consent has been given, the pupil may withdraw that consent for future use by contacting ProCarPass.

14. Personal Information

14.1 Personal information will be handled in accordance with applicable UK data-protection law and the ProCarPass Privacy Policy.

14.2 Personal information may be used where reasonably necessary to provide driving tuition, administer bookings and payments, maintain appropriate business records, deal with complaints or incidents, and comply with legal obligations.

15. Complaints

15.1 Pupils should raise concerns as soon as reasonably possible so that they can be investigated.

15.3 ProCarPass will aim to deal with complaints promptly, fairly and professionally.

16. Changes to These Terms

16.1 These Terms & Conditions may be updated from time to time.

16.2 Significant changes apply prospectively. Changes will not retrospectively alter the terms applicable to an existing dispute or an appointment already agreed unless both parties agree otherwise.

17. Acceptance of Terms

17.1 Pupils will be provided with or directed to these Terms & Conditions before or at the beginning of their tuition relationship.

17.2 Where a pupil signs the ProCarPass Student Agreement or otherwise expressly accepts these Terms & Conditions, they confirm that they have read, understood and agreed to them.

18. Governing Law

18.1 These Terms & Conditions are governed by the laws of England and Wales.

18.2 Nothing in these Terms & Conditions affects a consumer's statutory rights.
